1. Introduction
Welcome to Mustermaja.ee. The service is operated by Creatomus Solutions OÜ. On Mustermaja.ee we specialize in providing bespoke design services utilizing the innovative 3Cycle modular system. Our goal is to bridge the gap between your vision for a modular home and our manufacturing partners’ ability to realize that vision. By using our services, you agree to be bound by the following terms and conditions. Please read them carefully.
2. Services Provided
- Design Consultation: We offer personalized design consultation to understand your requirements and preferences for a modular home.
- Design Creation: Based on our consultation, we create a custom design using the 3Cycle modular system tailored to your needs.
- Manufacturing Coordination: Once the design is finalized, we facilitate obtaining an offer from a compatible manufacturer to construct and deliver the modular house.
3. Buyer and Manufacturer Relationship
- Contractual Relationship: The contractual relationship for the construction and delivery of the modular house is exclusively between you (the buyer) and the selected manufacturer. Creatomus Solutions OÜ acts as an intermediary in the design phase but is not a party to any agreement between the buyer and manufacturer.
- Liability: Creatomus Solutions OÜ is not liable for any disputes, losses, damages, or liabilities arising from the relationship between the buyer and the manufacturer.
4. Payment and Fees
Details regarding the payment for the design service, including any upfront fees, payment schedules, and methods, will be provided during the consultation process and before the initiation of any design work.
5. Intellectual Property
- Ownership: All designs created by Creatomus Solutions OÜ, utilizing the 3Cycle modular system, remain the intellectual property of Creatomus Solutions OÜ. Our creative designs, including all associated copyrights, trademarks, and other intellectual property rights, are and shall remain the exclusive property of Creatomus Solutions OÜ.
- License Grant: Upon full payment for the design service, Creatomus Solutions OÜ grants the buyer a non-exclusive, non-transferable, single-use license to use the design solely for the purpose of ordering the construction of the modular house from the factory. This license allows the buyer to use the design for their personal or commercial project, subject to the limitation that the design may only be used for a single construction project and may not be reused, resold, or distributed without express written permission from Creatomus Solutions OÜ.
- Restrictions: The buyer is not permitted to modify, alter, or create derivative works based on the design without the prior written consent of Creatomus Solutions OÜ. The buyer acknowledges that any unauthorized use, reproduction, or distribution of the design, or any portion thereof, is strictly prohibited and may result in legal action.
6. Termination
Either party may terminate the service agreement if the terms of service are breached, subject to any conditions outlined in the individual service agreement.
7. Changes to Terms of Service
Creatomus Solutions OÜ reserves the right to modify these terms of service at any time. Any changes will be effective immediately upon posting on our website.
8. Governing Law
These terms of service and any disputes arising out of or related to the services provided by Creatomus Solutions OÜ shall be governed by and construed in accordance with the laws of Estonia, without giving effect to its conflict of laws provisions.
